ghd Upgrade Programme – UK & ROI 

1. Terms & Conditions

1.1 These are the terms and conditions which apply to ghd’s Upgrade Programme (the “Upgrade Programme”). By participating in the Upgrade Programme, you will have the option to purchase a new full price ghd Chronos hair straightener (“new straightener”) from ghdhair.com (UK) or ghdhair.com/ie/ (ROI) (as appropriate, our “Website”) or participating salons at a reduced price when you trade in your old ghd straightener (the “old straightener”). Please read these terms and conditions carefully to find out further details about how the Upgrade Programme works. 

 1.2 This promotion is run by ghd; “ghd” is the trading name of Jemella Limited, company number 04115691 with its registered office address at 82 Dean Street, London, W1D 3SP.  1.3 The Upgrade Programme is a short-term promotion which will be available from 3 September 2024 until 30 September 2024 (or such earlier date as required depending on stock availability) (the “Promotion Period”). The Upgrade Programme is open to residents of the United Kingdom and Republic of Ireland only, and you must be over the age of 18 to participate. 

 1.4 Only old devices which are electrical hair straighteners manufactured by ghd may be traded in as part of the Upgrade Programme. The Upgrade Programme only applies when you buy a new ghd Chronos straightener, and is subject to availability.  

 1.5 The offer is limited to two purchases of new straighteners per customer, after which any additional purchases under the Upgrade Programme may be rejected at our sole discretion. We may also refuse to accept or cancel any orders placed under the Upgrade Programme where we have reasonable grounds to suspect fraudulent activity.  

 1.6 Only new straighteners purchased at full price are eligible for the Upgrade Programme. The Upgrade Programme cannot be used in conjunction with any other offer or promotion (including sale).  

 1.7 ghd reserves the right to amend or suspend the Upgrade Programme at any time.  

 

2. The Upgrade Programme – How it works 

     (a)   Via our Website 

2.1 To participate in the Upgrade Programme, you should add a full price ghd Chronos hair straightener to your basket. Enter code “UPGRADE” at checkout to notify us that you want to trade in your old straightener as part of the Upgrade Programme. When you complete your purchase, please be aware that the new straightener will be purchased at full price. You can purchase your new straightener using any of the payment methods available on our Website (including Klarna). 

 2.2 For UK orders,  we will include a prepaid returns shipping label and return information card in your delivery when we process and despatch your order for your new straightener under the Upgrade Programme. For ROI orders, contact our Customer Service team when you have received your new straightener to request a prepaid returns shipping label, which you can print and use to send your old straightener to us, as well as return information card.  

 2.3 You must safely package up your old straightener (using your own packaging) and send it to us using your prepaid returns shipping label within 14 days of receiving your new straightener. You should complete your return information card and include it in the package. Please obtain and retain proof of postage, in case your parcel gets lost in transit.  

 2.4 Once we have received your old straightener back from you, we will check that it is eligible for participation in the Upgrade Programme and that the relevant criteria have been met (set out in clause 3 below, the “Eligibility Criteria”). Once this has been verified, we will issue a partial refund via your original payment method for the new straightener within 14 days (or once we have received the old straightener from you, whichever is later). Please allow for additional time for ROI orders, where delivery can take longer.  

 2.5 The partial refund will be in the following amounts: £100 for UK orders and €115 for ROI orders (taking into account exchange rates). Any shipping or delivery fees when you send your old straightener to us will not be refunded. If you purchased your new straightener using Klarna, your partial refund will be issued via Klarna and handled by them directly. 

 2.6 Once your partial refund has been issued, please allow 3-5 days for the funds to reach your account although note this may differ from bank to bank and if you originally paid via Klarna. 

 2.7 The Upgrade Programme code can only be used once per order, meaning the maximum price reduction is set out in clause 2.4 above. 

 2.8 ghd’s Standard Terms and Conditions of Sale (which can be found here), will apply to the purchase of your new straightener, save as varied by these Upgrade Programme terms and conditions. These Upgrade Programme terms and conditions do not apply to normal purchases made from our Website. 

    (b)   In-salon 

 2.9 You can also take part in the Upgrade Programme by going to a participating salon in-person. Hand in your old straightener to the salon and you will receive the discount off your new straightener at the point of sale. Please be aware that salons set their product prices and discounts for ghd products independently. 

 2.10 Your old straightener must meet the Eligibility Criteria in order to qualify, and the salon will check this before issuing a discount on your new straightener.  They will arrange for your old straightener to be sent back to us directly.  

  2.11 The purchase of your new straightener from the salon will be governed by the contract of sale between you and the salon directly, and not ghd. Please refer to their terms and conditions and returns policy in-store. 

 

3. Your old straightener  

3.1 Once we have received your old straightener, you acknowledge that it becomes ghd’s property and we will be unable to return it to you. This applies whether or not your old straightener meets the Edibility Criteria below, and even if you change your mind about participating in the Upgrade Programme.   

 3.2 To participate in the Upgrade Programme and receive your partial refund, you must send us your old straightener within 14 days of receiving your new straightener. The following Eligibility Criteria will apply in order to qualify for the partial refund on your new straightener under the Upgrade Programme: 

 3.3 Your old straightener must be a genuine ghd straightener (any model). Other brands will not be accepted, and if we suspect that the old straightener is a counterfeit product we reserve the right to reject it and involve enforcement agencies if we deem it necessary to do so. 

 3.4 Other ghd products, such as hair dryers, wet-line products and accessories, are not eligible for the Upgrade Programme. 

 3.5 Your old straightener does not need to be in working order, but it must be in one piece with cord and plug still attached. 

 3.6 If you fail to send us your old straightener within 14 days of receiving the new straightener, or if upon inspection your old straightener is not an eligible product or does not meet the above criteria, you will not be able to participate in the Upgrade Programme and we reserve the right not to issue, or to cancel, the partial refund against the purchase of your new straightener. If in these circumstances you wish to return the new straighteners to us, you may do so in accordance with our standard returns policy. 

 3.7 When you return your old ghd straightener to us, we work with a trusted waste disposal partner to ensure these tools are disposed of responsibly.  

 

4. Your rights 

4.1 If you change your mind about the purchase of your new straightener via our Website, you are entitled to cancel your order and return it in accordance with our Returns Policy which can be found here. Any refund you receive will be the purchase price less the partial refund already issued to you under the Upgrade Programme. 

 4.2 Participating in the Upgrade Programme does not affect your statutory rights, including but not limited to your rights under the Consumer Rights Act 2015 in respect of faulty goods, and/or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (when purchasing via our Website). 

 

5. Data Privacy 

5.1 We will use the personal information you provide to us in accordance with our Privacy Policy, which you can find here. You agree that you have read and understood the Privacy Policy by participating in the Upgrade Programme. 

 5.2 For details of how salons may use your personal information, please speak to them directly. 

 6. Other Important Terms 

6.1 We may transfer our rights and obligations under these terms and conditions to another organisation. You may only transfer your rights or your obligations under these terms and conditions to another person if we agree in writing.  

 6.2 This contract is between you and ghd. No other person shall have any rights to enforce any of its terms. 

 6.3 Each of the paragraphs of these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining terms will remain in full force and effect. 

 6.4 If we fail to insist that you perform any of your obligations under these terms and conditions, if we do not enforce our rights against you or if we delay in doing so, that will not mean that you do not have to do those things, and it will not prevent us taking steps against you at a later date.  For example, if you do not pay and we do not request payment but deliver the new straighteners to you, we can still require you to make a payment at a later date.  

 6.5 For customers based in the UK, these terms and conditions are governed by English law, and you can bring legal proceedings in the English courts. For customers based in the Republic of Ireland, these terms and conditions are governed by Irish law, and you can bring legal proceedings in the Irish courts.
